Hi Everyone,
I was wondering if anyone has had any experience with reporting motorists to the police?
I was struck by a taxi on the way to work a few days ago and the police did not attend because I didn't think I was injured. The taxi driver gave me his name and details, as well as the owner's details, apologized, admitted fault and said he would "pay everything".
I have witnesses to the incident too.
As it happens the only damage to my bike is to replace the rear wheel. I have made a demand of him but he has failed to pay. It also seems that the number he gave me for the owner is incorrect too. Since that day my back has flared up but I do not expect my medical bills to be massive (I have insurance).
I want to report the driver for failing to give way, dangerous driving, breaching the terms of his taxi license and providing false information. The TAC have also advised that to proceed with my claim against them I need to obtain a police report.
I have looked up the road rules - it seems that I may have been crossing at a "marked foot crossing" in the absence of "bicycle lights". I may have broken a road rule. As you may be aware most of the bicycle related road rules prescribe fines of $350.00, which is more then I expect my out of pocket expenses to come up to in total.
I am afraid that if I report this incident to the Police they will turn around and fine me.
So the question to you is has anyone been in a similar situation? If I report the taxi driver is it likely to back fire and result in me being penalized? Are the Police even likely to check whether the intersection had bicycle lights or not? Also is there a particular Police unit which I should report this to, if indeed I decide to?

you can't report an incident to the police under the condition that you be made immune to prosecution for your own transgressions, that's kind of unrealistic. yes, you may be fined if you report an incident in which you have broken the law.

how bout you just forget to mention the part where u broke the law? he did hit u and give false information, why else would he lie to you unless he was at fault. :S
