Maybe Sleba knows what Pearson was doing, but probably not, as it is likely he (Sleba) was asleep or on drugs.

That's why I said "likely", not "he was".
Of course, he may not have been, but long-distance truck-driver.... open road.... no others about...... no adverse conditions (afternoon if I recall and they were both heading NNE I think on that road). You sort it out. Yes, I may be speaking with no evidence, but I'm not about to 'go in to bat' for the truck-driver. Shall listen for the trial verdict.

Not going in to bat for the bloke IP. Not at all. Just sick of the "I fell asleep" or "I was on drugs" crap excuse. How about "I just don't give a flying"? Sums it up for me. No extenuating circumstances, sorry childhoods, employer pressures etc. Just I don't care. Coz that's what it is.il padrone wrote:I don't.

When the forumula (sic) is so predictable, it chalks up as another blemish of a sick society that we can "understand the way the world works" being that money is the highest motivation. Follow the money and we're acknowledging it's OK to have an industry operating in a poverty state so that others can function and profit excessively from it.il padrone wrote:I don't.

The system (made up of us people) are OK to hang this guy out to dry and call it a day. Issue "should-nots" and point to the law, but not make any revolution waves that would affect anyone's comfort levels, then send condolences and prayers to the victim's family on Sunday.

Where has the disregard for vulnerable road users come from?fat and old wrote:Not going in to bat for the bloke IP. Not at all. Just sick of the "I fell asleep" or "I was on drugs" crap excuse. More importantly - has his licence been cancelled/suspended in the meantime or is he still driving amongst us? and or still driving trucks?

1. "It wasn't me that hit him".
2. "If I did hit him, it was the cyclists fault, because we can't be sure whether he had the taillight on or not".
I sometimes wish that judges would hold lawyers who run contradictory defences like this in contempt of court.

We have a case going on in WA where the defence is running a triple strategy:madmacca wrote:So from the news article, the defence is running a dual strategy:
1. "It wasn't me that hit him".
2. "If I did hit him, it was the cyclists fault, because we can't be sure whether he had the taillight on or not".

1. You proved my car hit her (because her DNA was found on the car's underbody) but that doesn't prove I was driving;
2. I have type 2 diabetes and had a hypoglycaemic episode so I was acting without conscious input (which I then miraculously recovered from without eating anything) if I was driving; and,
3. I have sleep apnoea and microslept through the collision, if I was driving and if I was not having a hypoglycaemic episode.

And wasn't evidence found at the cyclist death scene of a smashed headlight, that was later shown to match the recently replaced headlight of the driver's truck?
