I used the term driveway as a synonym of "road related area" - swap the words around and same deal.

The actual crossing point is constructed as a road crossing, not as a "road related area" crossing. I don't think it is unreasonable for motorists to be confused over who has priority at the crossing because the roads authority has constructed it to make it appear to be a road crossing.

If the path pavement was continuous across the crossing, or the crossing was raised at path level, it would be a different story as it would be pretty clear that the path has priority* at this crossing.

The legal grey area comes from whether a reasonable person would be expected to understand that what is designed, constructed and appears as a road crossing is actually a driveway.

* Not always the case though as some retarded Local Governments (e.g. Subiaco) love to put in raised crossings that aren't actually zebra crossings and confused the hell out of everyone
The pavement for the cyclepath is clear across the driveway.

In Australia that driver would be charged with either fail to give way or negligent driving, in america it will be no criminality suspected.

Have just recently ditched the crutches, but I've got a nasty limp. The physio sessions in the pool are really helping to build up the muscles in my leg that control balance. It can be painful at times, but I'm making progress these last two weeks, so I'm encouraged by that. Can't wait for a cheque from the driver's insurer so that I can order a new bike.

My friend wasn't the driver, but yes, the truckie stopped and some words were exchanged. He's incredibly lucky that a) the centre guard stopped him crossing the freeway, and b) the truckie stomped on the brakes.

A woman opened the door to exit the cab in Sussex St out the front of my work on Friday.

that is appallingly bad driving. even though the manouvre was unnecessary, it could have been done quite easily had the moron not run right up the arse of of the car before swerving into the next lane and losing control. actually i think that guy may have been in the crit race i was at this morning!

The above dooring reminded me that I nearly took out a door when I was driving a car down Lygon St in the heart of the restaurant area last weekend. When the front of my car was about 2 m back from her door, she opened it. Can only assume she didn't look. There would have been about 10cm in it (I had just turned left in to Lygon & was slightly straddling the right lane, had I been fully in the left lane I would have definitely hit the door). Would have to be a moron to not look when opening a door on Lygon (very narrow lanes).

She probably looked, didn't see you (as you hadn't turned the corner yet) and then opened it a few seconds later. Not real bright.
