Darebin Bridge - Booroondara Bicycle Strategy till 22 Feb

I see that Booroondara city has released their draft cycling strategy, including the contentious "Darebin Bridge" link between Heidelberg Road and the Yarra Trail.

Comment is invited closing 22 February (see the Booroondara Council .....roads/tppolicy/draftbikestrategy web page).

The Darebin Bridge is mentioned

"7.2.3 Inter Municipality
Item 17 - A significant network gap remains with the Darebin Creek Trail. Proposals are outlined by Bicycle Victoria. The link would complete a strategically important component of the PBN."

The Darebin Bridge link is listed as a high priority but is also about the most expensive thing to do at 3-4M$. No Booroondara council plans for the link are mentioned but it does refer to the Bicycle Victoria plans for the link maybe suggesting, soto voce, that the BV recommended route is the way to go.

Fortunately the money is available from the state government (no charge to the Booroondara rate payers) and environmental clearance for the proposed route near the soccer fields and billabong has been suggested by the Booroondara councils own reviewer, Dr Lorimer.

"Nov 07 Dr Graeme Lorimer has given the all clear for the path to the Darebin Bridge past the environmental sensitive Kew Billabong.
Dr Lorimer’s report commissioned by the City of Boroondara, states that the Darebin Bridge and associated shared path will not negatively impact on the vegetation or animal life in Willsmere Park or the Kew Billabong."

What is happening with the Darebin Bridge path by the Billabong? Have Booroondara and Darebin Councils considered the proposal to complete the billabong section yet?

How did the Boorondara Planning Committee meeting vote on the Darebin Bridge link last night?

I understand that the Planning C'ttee makes a recommendation which is then voted on again by the full council two weeks later.

The planning staff's advice on the link past the billabong certainly seemed positive.

VCAT got sick of waiting for Boroondara to make a decision and has 'called in' the Darebin Bridge bicycle link.

From the Bicycle Victoria website with interesting comments on the desirability of getting community agreement even though 'the community' has been doing a lot to delay or put off entirely the project.
This seems to be an effort by the Victorian government to councils to recognise the need for communities to change and modernise - code for get to grips with a denser population in a carbon-constrained world of high fuel prices and a need to promote incidental exercise such as walking and cycling for its health and congestion benefits.

Called in

5 June 2008. Parks Victoria has grasped the nettle and ‘called in’ the planning process for the Darebin Bridge and associate trials. The permits will now be considered by the Victorian Civil and Administrative Tribunal (VCAT).

This will result in a single streamlined approvals process where the application and all the objections can be heard together, and the formal approval, when issued would have a uniform set of conditions.

The exercise of this little-used power by Parks Victoria was unexpected, but justified. Although the project had support from Yarra and Banyule councils, Boroondara had had exceeded the time allowed for a decision.

Boroondara may or may not have approved the Bridge plan at its planning committee on 2 June—there was an officers’ recommendation in favour. But it was too late.

We could see that even with Boroondara support, it was likely that others would object to the permits. On the map we noted opponents or potential opponents such as the school, golf club and local residents.

Parks Victoria’s action means, we understand, that all objectors will have to front VCAT in one hearing.

In the short term Parks Victoria has acted in the best interests of the project. The VCAT hearing will draw out all the opposition, so that it can be considered at the one time. A prompt VCAT ruling—hopefully in favour of the project—will put a stop to all the huffing and puffing and mark the start of action.

We expect that councils will be miffed by Parks Victoria cutting short their processes, especially as they were already (or nearly) supporters of the project. We would never deny that thorough community consultation is important.

There will be long term benefits from Parks Victoria’s emphatic action. It signals a new mood of decisiveness on the Government’s part. Investment in bike riding infrastructure looks to be moving up the priority list.

The VCAT hearing is the next milestone. We will keep you informed.

Boroondara Council Planning Cttee has finally voted and approved the building of the 'Darebin Bridge' missing cyclepath link.

However the worth of the vote is moot as the Victorian state government 'called in' the project to VCAT two weeks ago.

The wording of the Boroondara planning cmttee motion suggests a bit of butt covering by the stood-aside council. Perhaps the Vic government reckoned that waiting since 31 August 2007 for approval (which was in essence a re-activation of a plan already approved in 2005 but which had lapsed) was evidence of foot dragging by the council?

In particular the phrasing of the first part of the motion suggests sour grapes on the part of the council
"1. That had an appeal against Failure to Grant a Permit not been lodged a Notice of Decision to Grant a Planning Permit (No. PP07/00882) allowing the Darebin Creek Trail connection to the Main Yarra Trail ..........(Willsmere Park) would have been issued under the Boroondara Planning

Bicycle Victoria has been keeping us informed according to the mushroom principle even though BV claims to want pro-cycling interests to be visible and heard at the VCAT hearing.

Anyone know if it is still on, what submissions have been made (especially by Banyule?) and how / when / if Bicycle Victoria intends to inform riders of progress during the hearing?

WHEN did Melbourne become a city of people opposed to anything built near them? The "not in my backyard" clique has become dominant in many parts of Melbourne, to the city's detriment.

Let's consider a few examples. For 20 years, Bicycle Victoria has been calling for a 1.8-kilometre bike path to connect the Darebin Creek bike route with the Yarra River main trail. Now opponents have labelled it a "bicycle commuter freeway" and are fighting it all the way. Its future is being decided by the Victorian Civil and Administrative Tribunal.

The opponents are not against the path or cycling, they insist, just the route the path would take. It's a classic not-in-my-backyard mentality........."

Darebin Creek – Main Yarra Trail Link: Graeme S attended the Practice Day Hearing on Friday 5thDecember2008 as Julia B’s substitute. Graeme outlined the proposed program for the VCAT hearing starting on 16thFebruary.This includes site visits but it is unclear whether these will include looking at alternative routes for the link. Julia Bsaid the she was unsure what her role was at the hearing – whether it included the options of putting in a writtensubmission or speaking. It was agreed that it is highly desirable that someone puts the cycling point of view at thehearing and there appears to be no-one else to do this. Parks Victoria currently has no expert witness on cycling. Itwas agreed that Julia should seek clarification from Parks Victoria’s legal team or direct from Parks Victoria.Assuming the right to lodge a submission and/or to speak we need to workshop this in early and late January as Juliawill be away from 10-20 January. John B and Jason D agreed to assist with this. Concern was expressed that the newBoroondara Council could be split 5-5 on this issue and that Chairmanship of Council and the Planning Committeecould be critical in avoiding a reversal of council’s current approval of the link. Jason D indicated that Yarra Councilcould be the key to resolving the issue of alternative routes as these would impact most on Yarra.

The "not in my backyard" attitude is particularly prominent in Boroondara.

At least after having blacked out most of the bike paths along main roads a few years ago, they've repainted the bicycle logo back onto some of them. What's really needed along some of the main roads like Barkers, Burwood etc are properly painted lanes the full length. The drivers around here don't take any notice of things like this unless they're right in their faces!

REASONS

These proceedings involve permit applications by Parks Victoria for the Lower Darebin Creek Shared Trail through the municipalities of Banyule, Yarra and Boroondara. The shared bicycle/pedestrian trail will connect the existing trail, which presently ends at Heidelberg Road, to the main Yarra Trail at Willsmere Park, Kew.
A 7 day hearing of these proceedings was scheduled from 16 – 24 February 2009. The hearing proceeded on Day 1 and there was an accompanied inspection of the route on Day 2. At the commencement of the hearing on Day 3 (18 February 2009), Parks Victoria advised the Tribunal that there had been a “breakthrough” in negotiations with Latrobe Golf Club relating to the route of the Trail, and certain design details within the Golf Club land, which have been major issues in contention between these two parties for a long time. As well, there have been successful negotiations relating to acquisition of the land for the Trail. Parks Victoria therefore requested an adjournment of at least the Yarra proceeding to enable the agreement to be documented and any necessary amendments to the concept plan and the permit application to be made. The Tribunal invited other parties to make submissions about the adjournment request.
Despite a strong preference by the Tribunal to proceed, if possible, so as to maximise the use of time and avoid inconveniencing parties who made arrangements to attend the hearing, we were unable to devise a satisfactory set of procedural directions without potentially creating confusion, which would result in parties having to make piecemeal submissions or present evidence in a piecemeal fashion. We therefore considered that it would be simpler, fairer and more expedient for all parties to adjourn all the proceedings in order to enable Parks Victoria to complete its negotiations with Latrobe Golf Club and formulate appropriate amendments to the permit application. That enables suitable notice to be given of the foreshadowed amendments and when the hearing reconvenes, everyone will have the benefit of knowing exactly what is now proposed. It will also enable Melbourne Water’s view to be heard, as a number of submissions relate to the height of the proposed bridge over the Yarra River and other flood related matters for which Melbourne Water is the relevant referral authority and floodplain manager.

LaTrobe Golf Club was supposed to hold its AGM on 12 June.

A motion for Approval from members for the Committee to negotiate sale of the land necessary was the main item of business. In fact, so main it was Extraordinary and so required 75% of members to vote in favour for it to be passed.

I presume it passed as the clubs own advice was that failure to do so would result in compulsory purchase which would be less satisfactory for the club.

Negotiations for survey and sale of the land should be well advanced by now.

Any news on this and on when VCAT will re-hear the Darebin Bridge link application?

Bicycle Victoria has updated their website with a reference to progress of the Darebin Bridge project through the VCAT process. Good on BV for posting that so promptly.

But it seems that many of the current riders will have retired from commuting or become fertilizer before the necessary land is transferred, funding re-found and the path built.

Meanwhile Brisbane will almost certainly have built a bike bridge from Bulimba to Newstead by then, with the Kurilpa Bridge between South Brisbane and the legal western business precinct and links to the northern suburbs bikeway due to open in two months.

Hearing complete—now for the decision
28 July 2009. The final VCAT hearing on the permits for the bridge has been completed, with objectors failing to lay a glove on the Parks Victoria plan for the project.
The tribunal is expected to announce its decision in about a month.
As expected VCAT was told that the LaTrobe Golf Club had agreed to sell a critical parcel of land to the project, clearing the last remaining obstacle for the bridge to proceed to the design stage.
Should the Tribunal give the go ahead, complex and lengthy legal processes will begin to transfer property to Parks Victoria. These could take more than 12 months to complete.
Construction of the bridge could take several years after that, bringing to 17 years the total time since Bicycle Victoria began the campaign to get the bridge built.

It has been a mere three years since the last post on this topic.
After a long period of inaction there is activity on the Darebin Creek Trail extension to the MYT
A foundation is being constructed under the Heidelberg Road bridge.
At this rate it should be complete in time for the next millenium celebrations

Great news KenGs.

In the meantime the less people friendly cities of;
Brisbane has finished the Kurilpa Bridge, expanded the Coronation bikeway, built the Toowong Freeway overpass and another bridge out in the Jindalee suburban wilderness;
Sydney has built multiple city cycleways
Perth has extended the Bayswater railway alignment separated bikeway, raised the Kwinana freeway seawall and built a bikeway on part of it

The foundations you mention haven't shown up on NearMap yet (3 July)

Now that the work is underway it is progressing quite quickly. It must have started in the last week or so as the last time I was down there nothing was happening. Now the work has moved to the west side of Heidelberg Road and the big tree blocking the path has been removed.

Melbourne has added 30 metres to its bicycle network with the opening up of the extension to the Darebin Creek trail. The trail now stops at the bridge while the bridge works are being completed.
The balustrade needs to be finished on the creek side under Heidelberg Road as you can see in the photo. Not sure why this is the only bit not done.
Is it a jurisdiction issue between Banyule and Darebin? Has the contractor gone bust? Has funding run out? Does the timber need to cure? Do the foundations need to settle? Are we waiting on Ted Baillieu to give it his seal of approval?
