Say What???? How on earth is that anyway possible? Makes you really question our courts when its now possible to flee an accident to get yourself help while leaving someone dying on the roadside. Utterly deplorable

No. It's the 'perverting the course of justice' charge they were acquitted of. It's entirely possible that the law was correct but that justice was not served. They are not mutually incompatible. Overall, however, the outcome leaves me feeling distinctly sick.

The legal system has nothing to do with justice or a fair go!
It's a pure and simple trough for the social pigs to wallow in and screw the little guy everytime. :x
So now a cyclist is only worth a piddling $3100.00. :evil:

"Conspiracy to pervert the course of justice". A bridge too far. It really needed one of those involved to give evidence to support the charge, as the defence argued that McGee could have been avoiding the police (and a mandatory breath test) for any number of lawful reasons. Without evidence the prosecution could not convincingly point to an unlawful reason. That such a defence argument could fly is the reason you pay the best QC in the state.

The result is that a member of the police and legal fraternity in SA can (perhaps unlawfully) kill someone; manipulate the system they know so well; and not face an appropriate penalty. In that sense, this behaviour fits the very essence of "pervert the course of justice" and the lack of punishment of those involved damns the behaviour of SA's police, lawyers and legislature. Not to mention the McGee brothers themselves, may they rot in hell.

Reported in Advertiser that Rau (SA Attorney Gen) is looking into this, and there is a possible avenue for the family to pursue McGee.

Hope they get him in the end.

Attorney-General John Rau will not refer the past behaviour of hit-run lawyer Eugene McGee to a legal tribunal.

Mr Rau had sought legal advice over whether he could refer the case to the Legal Practitioners Disciplinary Tribunal, after the Legal Practitioners Conduct Board earlier this year absolved McGee...

The only penalty McGee has received is a $3100 fine for driving without due care.

I do not understand how this man, who hit someone with his car and then decided that arranging his own defence was more important than rendering assistance, was not charged with manslaughter.

He's a financially secure lawyer, driving a smokebox, he killed a cyclist. Game over for justice.
...whatever the road rules, self-preservation is the absolute priority for a cyclist when mixing it with motorised traffic.

Welcome to a new year of Australian Story! Now let’s get straight into it...

A notorious hit-and-run cyclist incident that changed lives and changed the system launches our new season. You may remember seeing this on the news in 2003. A prominent Adelaide lawyer named Eugene McGee hit and killed cyclist Ian Humphrey. He failed to stop after the collision and more than six hours passed before he turned himself into police. After eight years, two trials and a Royal Commission, the penalty paid by Mr McGee was a $3100 fine and the loss of his driving license for one year.

For the first time, the inside story of this controversial case is told by Ian Humphrey’s widow Di Gilcrist and his daughter, Chloe. Key legal, medical and political figures including the SA Victims of Crime Commissioner, the former SA Attorney General and MP Nick Xenophon also feature. And Eugene McGee gives his first interview since the fatal collision.

Sydney based producer Ben Cheshire, editor Ian Harley and head of research, Mara Blazic, have been working hard putting together this two part program. The first instalment of ‘Road To Nowhere’ airs this Monday night at 8pm on ABC1.

The media release appeared on the same day as a massive fire in an oil recycling plant in Adelaide's north, which was the lead story on all outlets.

On 2012-03-14 at 8:30am ABC891 radio interviewed Rau, Xenophon and Atkinson. Attorney-General Rau defended his decision not to pursue an appeal to the decision of the Legal Practitioners Conduct Board due to legal advice about "lack of evidence". This was critcisised by Xenophon (now a Commonwealth senator, but previously a lawyer specialising in motor accidents). The radio presenters contrasted this decision to the government's appeal against legal advice in the Nemer case. Former Attorney-General Atkinson was accussed by Rau of "sitting on his hands" but responded that the verdict of the criminal court occurred three days before the state election, after which Atkinson was no longer Attorney-General.

A cyclist down the bay on Saturday morning was taking signatures for a petition to have this guy barred from practicing law again. I signed it but given how his initial trial went, I hold little faith his justice buddies are going to allow such a motion to proceed.
