Hey guys..

So long story short I got back to Perth and went for a ride when a silly young girl with no indication turned in to me whilst riding.

Had a big crash went to hospital, all muscles are buggered and broken elbow.

My question is with my Look bike. The front wheel and hoods/shifters are buggered. The frame looks in tact however I'm afraid there could be internal fractures in the frame I might not be able to see.

What process do you fellow cyclist take when assessing the damage and the process of insurance claims via the driver that hit me. (Police report made online)

In this instance its my word against hers and with no witnesses doesn't help the matter.. In honesty if the bike is not covered I couldn't care as I'm at least alive..

Be cautious from silly drivers and be safe on the roads boys/girls.. (Which everyone already knows)

Sounds like the plods should be able to pin some negligence on her if she turned into you. If that's the level of damage to you, I'd suggest there could be frame damage. I'd only let Aldo at quantum have a look (Scarborough beach road) as he should be able to give a pretty accurate quote.

if you have her details (and she was bound to provide them, if requested at the scene), you should send her a bill for the cost of replacing stuff. you might want to get a quote from your LBS on that. without a witness, the cops are unlikely to take action. a common misconception is that in that case, you can't recover losses from her. that isn't the case, as the test of civil liability is based on the balance of probabilities (someone can find the precise term), rather than proof beyond reasonable doubt. if she refuses, you can issue a writ for your claim to be heard in the magistrate's court. you don't need a lawyer for that - this isn't constitutional law, you can just tell your side of the story and the magistrate will almost certainly apportion you a share of the costs, depending on how you both present. in practice, she won't want to go to court - particularly if she knows she was in the wrong and will probably offer you a settlement.

In hindsight if it ever happens again call an ambulance. The police will also attend and take statements and hopefully the driver will admit it's their fault. Anyway it did'nt happen so hopefully the driver is honest
I think Oxford has a template in the Safety and Advocacy Forum. I used a lawyer to send a letter of demand but the driver ignored it. A further letter was sent and I waited and waited until I got fed up and had the local legal service send a final letter of demand. I've been to the Magistrates Court and got the word on sueing the driver. Some 8 months down the track I have an offer of settlement from the drivers insurance company which is half the lowest quote which I rejected. I'm waiting for another offer. I'm glad your alive to which is really whats important. But it's also important that you are compensated for the damage to your bike. It's likely that it will be written off as a full scan of the frame can cost $800 or more. Add the cost of the wheels and other damage and it's better to write it off. So get 2 quotes from LBS's and send them with a letter of demand to the driver as soon as you can.

The plods can't pin anything on her, especially negligence. They wer'nt there and even if they were she might get a ticket for failing to indicate when making a turn.

Thanks everyone for your help and support.

I will most certainly take note for future incidents, but when your semi unconscious its hard to ask for an ambulance when your dealing with a silly young girl on her P plates that has little regard for road rules or assisting someone who is injured.

At this point I couldn't care if I lose the cost of the bike, as most of you mentioned at least I'm still here

Ouch. I came off a couple of weeks ago, just lots of skin missing, thankfully. The boss of my house just said "You'd better take out income protection insurance". Such an understanding girl.

Not too sure of some of the 'advice' being given.........but here in WA..

The driver of a vehicle must report a traffic crash when the incident occurred on a road or any place commonly used by the public, e.g. carparks; and
the incident resulted in bodily harm to any person; or
the total value of property damaged to all involved parties exceeds $3000; or
the owner or representative of any damaged property is not present.

Hey Rabo, accidents suck!

Hopefully everything mends properly and with a bit of luck you will get a decent resolution for damages.

After I reported mine the cops did the offending person for failing to report an accident and also for failure to give way.

I had my bike insured so I claimed through that and then they got the money back from the driver. It's much easier to pay the excess and let the insurance companies battle it out.

I forgot all about the law saying it needs to be reported!! I did that after someone booted me up the bum while driving so shoulda remembered.

How are you feeling ow mate after things have had time to stiffen up?

Now feeling much better so long as I dont move too much.. Neck is stuffed..

Happened on the roundabout near burns beach/joondalup. Checked cars for indicators and everyone was heading straight, therefore I proceeded and the next thing a Hyundai Getz at the last minute decides to turn left half way through the roundabout into me.

As much as I could remember her two responses were " You can only turn left in the left lane anyway" (Incorrect) & "I was running late to pick up my puppies as I finished my exam"

Bugger of a spot that. It's just nasty from every direction. Bit embarrassing though - a Getz!! I'm surprised her car didn't need towing You definitely need to get the plods involved if she can't even notice which lanes have huge turn arrows on them. I bet she's one of those people who come off the freeway down bb road and can't be bothered waiting to turn left, so uses the right lane anyway

Not sure if it will help, but I've been seeing the guys at Ascend Physio at Challenge Stadium and love their work. As they get a lot of WAIS athletes through, I trust them a lot and they have given me really good treatment and exercises which have worked better than the last 2 physios I've seen. They also have physios who specialise in specific ailments (pretty sure one does neck/shoulder). Worth a look if you need that sort of treatment.

Recovering from a crash myself Rabo, and so I really feel for you, the healing is dragging on in my case and its not a lot of fun. Patience and strength my friend, rest hydration and nutrition, treat your body well and stretch the healing bits gently to regain movement and stay limber...within what your physio tells you of course.

Hope recovery goes smoothly and there's a resolution of the bike damage.

It never nice to read about these things. A broken elbow can't be a pleasant result. I hope the prognosis is good.

I don't want to seem like I am blaming the victim but putting life and limb on the line based on the status of a cars indicator seems somewhat trusting. Number one rule is not to trust motorists.

But maybe I'm not understanding the situation...

Crashes really suck. I've never had one on a pushbike but got clobbered in a SMIDSY incident whilst on my motorbike a few years back. I was luckier than you and walked away with no injury. Bike a write off. I packed in motorcycle riding about 2 years later. My conscious brain told me I was just bored with it but I have my doubts. The lizard brain doesn't respond to interrogation, just does what it will to protect a person!

I saw you're selling stuff in the Marketplace, made me a bit sad. It would be good to see you get back on the horse as it were, but I know I'm not alone in understanding the self preservation instinct.

That's no good Rabo heal up well. I guess we all could have been you. There is a round about on my normal ride Eddystone ave Craigie, I've ridden around it several times while wanting to go straight to stop being run over. Close to home take it easy mate.
